Only Used Tesla operates a technology marketplace that allows Tesla owners to receive purchase offers from independent motor vehicle dealers. Every offer identifies the dealer making the offer. Only Used Tesla does not make the offer and does not purchase, own, inspect, possess, transport, or take title to any vehicle.
If you select a dealer’s offer, you authorize Only Used Tesla to share your contact and vehicle information with that dealer and connect you so the transaction can proceed. Selecting an offer records your intention to proceed but is not, by itself, the dealer’s final vehicle purchase agreement.
The dealer—not Only Used Tesla—is responsible for verifying your identity, ownership, title, lien, payoff, mileage, equipment, condition and vehicle history. The dealer is also responsible for providing the purchase agreement, making all payments, completing the title and odometer documents, and arranging pickup or transportation.
Dealer offers may contain stated conditions, including inspection, mileage, vehicle condition, title and payoff verification. Any proposed price change must be explained by the dealer and expressly accepted by you before the vehicle is released.
If your Tesla has a loan, the dealer will obtain or confirm the lender’s official payoff amount. If the purchase price exceeds the payoff, the dealer is responsible for paying the remaining positive equity directly to you. If the payoff exceeds the purchase price, you are responsible for paying the negative equity according to the dealer’s and lender’s written instructions. Payoff and equity amounts displayed by Only Used Tesla are estimates until confirmed in the dealer’s purchase documents.
Only Used Tesla does not receive or hold the vehicle purchase price, lender-payoff money, seller-equity payment, title, keys, or vehicle. Payment, payoff, title and pickup timing vary by dealer, lender and state.
To the fullest extent permitted by law, claims arising solely from a participating dealer’s inspection, offer adjustment, payment, payoff, title work, transportation or other conduct must be addressed directly with that dealer. Nothing in these terms limits any responsibility of Only Used Tesla that cannot lawfully be excluded.
You represent that you are the vehicle’s owner or are legally authorized to sell it and that the information you provide concerning its title, liens, mileage, condition, history and ownership is accurate. To the fullest extent permitted by law, you agree to indemnify Only Used Tesla against third-party claims resulting from your fraud, knowing misrepresentation, lack of authority to sell the vehicle, undisclosed liens or breach of these terms. This obligation does not apply to claims caused by Only Used Tesla’s own unlawful conduct, gross negligence or willful misconduct.
